Even when <strong>no construction work<\/strong> is carried out, you often have to apply for a permit to change the main function of a building. <\/p><p>A change of use can have major legal consequences. Therefore, it is important to check in advance which rules apply and whether a permit is required. <\/p><h2>What is a change of use?<\/h2><p>A change of use means that a building or space is given a <strong>different main function<\/strong> than originally permitted. A building can have one of the following main functions, among others: <\/p><ul><li>Residential<\/li><li>Residential recreation or day recreation (incl. sports)<\/li><li>Agriculture and horticulture<\/li><li>Retail<\/li><li>Catering (restaurant, caf\u00e9, dance hall)<\/li><li>Office function, services, and liberal professions<\/li><li>Industry and business activity<\/li><li>Community facilities and public utilities<\/li><li>Military function<\/li><\/ul><p>When you change one of these functions, it is legally referred to as a change of use.<\/p><h2>When is a change of use subject to a permit?<\/h2><p>In principle, a change of use is <strong>subject to a permit<\/strong>, even without physical works. Some typical examples: <\/p><ul><li>Converting a warehouse into a home<\/li><li>Using a farmstead as a residence without agricultural activity<\/li><li>Permanently inhabiting a building in a recreational area<\/li><li>Renting out (part of) a home for residential recreation, such as via Airbnb<\/li><\/ul><p>The <strong>reverse<\/strong> also applies: a non-residential building used as a home usually requires a permit.<\/p><h2>Exemption from permit: when is it possible without one?<\/h2><p>For functions that are <strong>complementary to living<\/strong>, an exemption may apply under certain conditions. Consider, for example: <\/p><ul><li>Office or liberal profession<\/li><li>Service provision<\/li><li>Small-scale retail<\/li><li>Catering<\/li><li>Limited business activity<\/li><\/ul><p><strong>Conditions for exemption (Flemish level):<\/strong><\/p><ul><li>The building is located in a residential area or similar zone<\/li><li>The residential function remains the main function<\/li><li>The secondary function is smaller than the residential function<\/li><li>Maximum <strong>100 m\u00b2<\/strong><\/li><li>Not in conflict with RUP, BPA, regulations, or recent allotments<\/li><li>Temporary use: max.  <strong>4 \u00d7 30 days per year<\/strong><\/li><\/ul><p>\u26a0\ufe0f Municipalities may impose <strong>additional conditions<\/strong>. Always inquire locally. <\/p><h2>Non-conforming zone? Then different rules apply <\/h2><p>If the building is <strong>located in a non-conforming zone<\/strong>, then <a href=\"https:\/\/omgeving.vlaanderen.be\/toelaatbare-zonevreemde-functiewijzigingen\" target=\"_blank\" rel=\"noopener\">specific and often stricter rules<\/a> apply. In that case, a change of use is usually not exempt and a permit is required. <\/p><h2>Notification or permit?<\/h2><p>There is <strong>no notification requirement<\/strong> for changes of use.<br\/>\u2192 <strong>No exemption? Then a permit is mandatory<\/strong>, and this <strong>before<\/strong> the change of use takes place.<\/p><h2>Is an architect mandatory?<\/h2><p>For a <strong>pure change of use<\/strong>, the cooperation of an architect is <strong>not mandatory<\/strong>.<\/p><p>\u26a0\ufe0f Please note:<br\/>If <strong>works<\/strong> are associated with the change of use, an architect may still be mandatory.
