M\u00eame lorsque <strong>aucun travail de construction<\/strong> n\u2019est effectu\u00e9, vous devez souvent demander un permis pour modifier la fonction principale d\u2019un b\u00e2timent. <\/p><p>Un changement d\u2019affectation peut avoir des cons\u00e9quences juridiques importantes. C\u2019est pourquoi il est important de v\u00e9rifier au pr\u00e9alable quelles r\u00e8gles s\u2019appliquent et si un permis est requis. <\/p><h2>Qu\u2019est-ce qu\u2019un changement d\u2019affectation ?<\/h2><p>Un changement d\u2019affectation signifie qu\u2019un b\u00e2timent ou un espace re\u00e7oit une <strong>autre fonction principale<\/strong> que celle initialement autoris\u00e9e. Un b\u00e2timent peut notamment avoir l\u2019une des fonctions principales suivantes : <\/p><ul><li>Habitation<\/li><li>Loisirs de s\u00e9jour ou de plein air (y compris le sport)<\/li><li>Agriculture et horticulture<\/li><li>Commerce de d\u00e9tail<\/li><li>Horeca (restaurant, caf\u00e9, dancing)<\/li><li>Fonction de bureau, prestation de services et professions lib\u00e9rales<\/li><li>Industrie et artisanat<\/li><li>\u00c9quipements collectifs et services d\u2019utilit\u00e9 publique<\/li><li>Fonction militaire<\/li><\/ul><p>Lorsque vous modifiez l\u2019une de ces fonctions, on parle juridiquement d\u2019un changement d\u2019affectation.<\/p><h2>Quand un changement d\u2019affectation est-il soumis \u00e0 permis ?<\/h2><p>En principe, un changement d\u2019affectation est <strong>soumis \u00e0 permis<\/strong>, m\u00eame sans travaux physiques. Quelques exemples typiques : <\/p><ul><li>Transformer un entrep\u00f4t en habitation<\/li><li>Utiliser une ferme comme habitation sans activit\u00e9 agricole<\/li><li>Habiter de fa\u00e7on permanente un b\u00e2timent situ\u00e9 en zone de loisirs<\/li><li>Louer (une partie d\u2019) une habitation pour des loisirs de s\u00e9jour, par exemple via Airbnb<\/li><\/ul><p>L\u2019<strong>inverse<\/strong> est \u00e9galement vrai : un b\u00e2timent non r\u00e9sidentiel utilis\u00e9 comme habitation n\u00e9cessite g\u00e9n\u00e9ralement un permis.<\/p><h2>Dispense de permis : quand est-ce possible sans ?<\/h2><p>Pour les fonctions qui sont <strong>compl\u00e9mentaires \u00e0 l\u2019habitation<\/strong>, une dispense peut s\u2019appliquer sous certaines conditions. Pensez par exemple \u00e0 : <\/p><ul><li>Bureau ou profession lib\u00e9rale<\/li><li>Prestation de services<\/li><li>Petit commerce de d\u00e9tail<\/li><li>Horeca<\/li><li>Activit\u00e9 limit\u00e9e<\/li><\/ul><p><strong>Conditions de dispense (niveau flamand) :<\/strong><\/p><ul><li>Le b\u00e2timent est situ\u00e9 en zone r\u00e9sidentielle ou zone similaire<\/li><li>La fonction r\u00e9sidentielle reste la fonction principale<\/li><li>La fonction accessoire est plus petite que la fonction r\u00e9sidentielle<\/li><li>Maximum <strong>100 m\u00b2<\/strong><\/li><li>Non contraire au RUP, BPA, r\u00e8glements ou lotissements r\u00e9cents<\/li><li>Usage temporaire : max.  <strong>4 \u00d7 30 jours par an<\/strong><\/li><\/ul><p>\u26a0\ufe0f Les communes peuvent imposer des <strong>conditions suppl\u00e9mentaires<\/strong>. Informez-vous toujours localement. <\/p><h2>Hors zone ? Alors d\u2019autres r\u00e8gles s\u2019appliquent <\/h2><p>Si le b\u00e2timent est <strong>situ\u00e9 hors zone<\/strong>, des <a href=\"https:\/\/omgeving.vlaanderen.be\/toelaatbare-zonevreemde-functiewijzigingen\" target=\"_blank\" rel=\"noopener\">r\u00e8gles sp\u00e9cifiques et souvent plus strictes<\/a> s\u2019appliquent. Dans ce cas, un changement d\u2019affectation n\u2019est g\u00e9n\u00e9ralement pas dispens\u00e9 et un permis est requis. <\/p><h2>Notification ou permis ?<\/h2><p>Pour les changements d\u2019affectation, il n\u2019existe <strong>aucune obligation de notification<\/strong>.<br\/>\u2192 <strong>Pas de dispense ? Alors un permis est obligatoire<\/strong>, et ce <strong>avant<\/strong> que le changement d\u2019affectation n\u2019ait lieu.<\/p><h2>Un architecte est-il obligatoire ?<\/h2><p>Pour un <strong>pur changement d\u2019affectation<\/strong>, le concours d\u2019un architecte n\u2019est <strong>pas obligatoire<\/strong>.<\/p><p>\u26a0\ufe0f Attention :<br\/>Si des <strong>travaux<\/strong> accompagnent le changement d\u2019affectation, un architecte peut tout de m\u00eame \u00eatre obligatoire.
