Subdividing land: applying for an environmental permit for subdivision
Dividing a piece of land into multiple building plots? Then you need an environmental permit for subdivision. Without this permit, a parcel cannot be legally sold as building land.

What is an environmental permit for subdivision?
Subdividing means dividing a parcel into two or more lots for the purpose of:
- sale of building land
- long-term rental (more than 9 years)
- establishment of a long-term lease or building rights
- development of homes or other buildings
Without a permit, these parcels may not be brought onto the market as building land.
When is a subdivision permit mandatory?
A permit is required as soon as you:
- split land with the intent to build
- create new building lots
- change building lines
- construct or adapt infrastructure
In many cases, a pre-cadastral registration is also required before sale.
How does the application procedure work?
The application is submitted to the Board of Mayor and Aldermen via the Omgevingsloket.
Step 1 – Preparation of the file

- building line plans if necessary
- technical notes
Step 2 – Completeness check
The municipality has 14 days to declare the file complete or incomplete.
Step 3 – Advice and public inquiry
Depending on the location, the application may be subject to:
- Advice from the regional urban planning official
- advice regarding regional roads or protected zones
- Public inquiry
Step 4 – Decision
The decision period is a maximum of 150 days, possibly extended by the duration of the public inquiry.
When is a public inquiry necessary?
A public inquiry is required when the subdivision:
- falls outside a BPA or RUP
- is larger than 5 hectares
- provides for multi-family homes in a single-family environment
- changes building lines
- relates to protected or sensitive areas
Objections can be submitted during this period.
What about changing an existing subdivision?

Then an amendment application can be submitted.
Important:
- Co-owners must be informed in writing
- In the event of a majority of reasoned objections, the amendment may be refused
