A right of superficies is a legal property right whereby someone is granted the right to construct or maintain buildings, works, or plantings on, above, or below a property, without being the owner of the land on which they are located.
A volumetric right of superficies is a specific application of the right of superficies where the right is defined in three dimensions – not just in surface area (2D), but also in height and depth (3D). It therefore concerns a “volume” in space, in which the superficiary has exclusive rights, independent of the land around, above, or below it.
